General Terms and Conditions

1. The Parties

Provider: ABSOLUTE FIDES SRL, a Romanian legal entity, registered with the Trade Registry Office attached to the Prahova Tribunal under no. J2015001483299, CUI 35123162, with registered office in Sat Valea Largă, com. Valea Călugărească, nr. 203C, camera nr. 1, jud. Prahova, România, hereinafter referred to as "Absolute Fides" or "we".

Beneficiary: any legal person or authorized natural person who accesses the site, requests a quote or enters into a transport contract with Absolute Fides, hereinafter referred to as "the Customer" or "you".

2. Scope of services

Absolute Fides offers the following services:

• Road freight transport within the territory of Romania and the European Union
• Refrigerated transport with temperature control (adjustable temperature)
• Curtain-side (tautliner) transport for palletized goods
• Oversize and mega trailer transport (high volume)
• Express delivery (rapid, urgent transport)
• Adjacent logistics services (consolidation, temporary storage, handling)

The services are provided exclusively on the basis of a firm order accepted by Absolute Fides, in accordance with a validated price quote and a transport contract (CMR or equivalent document).

3. Quote request via the site

Filling in the contact form does NOT constitute a firm order and does not create contractual obligations. It is a quote request, evaluated individually by the Absolute Fides team.

1. The Customer fills in the form with minimum details (type of goods, route, dimensions, weight, date)
2. Absolute Fides analyzes the request and replies with a written quote within a maximum of 2 business hours
3. The quote contains: price, payment terms, estimated time, special conditions
4. The quote is valid for 7 calendar days from issuance, unless otherwise specified
5. Acceptance of the quote by written email (express confirmation) triggers the conclusion of the contract

4. Rates and payment

Rates are set per trip, depending on: distance, type of goods, dimensions, weight, urgency, special requirements (refrigerated, ADR, oversize). All prices are expressed in EUR or RON, excluding VAT, unless otherwise stated.

Standard B2B payment terms:

• Payment term 30 days from invoice issuance (negotiable per contract)
• Payment exclusively by bank transfer to the Absolute Fides account
• For new customers or international trips: possible request for a 30% advance
• Late payment interest: 0.1% / calendar day, in accordance with Law 72/2013
• The invoice is issued upon delivery or upon completion of the trip, in accordance with Romanian tax provisions

5. Obligations of the Customer

• Providing real and complete data about the goods (type, weight, dimensions, declared value, hazardous nature)
• Preparing the goods on time and at the agreed place, properly packaged for transport
• Providing the necessary documents (invoice, customs declarations where applicable, sanitary certificates for refrigerated transport)
• Designating a contact person at loading and unloading
• Payment within the agreed term
• Immediate notice of any problem arising during the transport

6. Obligations of Absolute Fides

• Providing the services with professional diligence and observing the agreed deadlines
• Using a fleet compliant with EU regulations (tachograph, emissions, periodic technical inspection)
• CMR insurance valid throughout the entire duration of the transport
• Prompt communication (reply to any request within a maximum of 2 business hours)
• Confidentiality of the Customer's commercial data
• Updates from the dispatcher at loading, on delays and at delivery

7. Limitation of liability

The liability of Absolute Fides for damage caused to the goods is governed by the CMR Convention (Geneva 1956) for international transport and by the Romanian Commercial Code for domestic ones. In particular:

• Maximum compensation: 8.33 SDR (Special Drawing Rights) / kg of damaged goods (Art. 23 CMR)
• Claim period: 7 business days for apparent defects, 21 days for hidden defects, in accordance with the CMR
• Absolute Fides is not liable for: force majeure, fortuitous event, inherent defects of the goods, defective packaging, erroneous instructions of the Customer
• We do not cover indirect or reputational damages (loss of profit, delays in the production chain)

For high declared values or sensitive goods, the Customer may request additional insurance (cargo insurance), with a transparent cost included in the quote.

8. Force majeure

Neither party is liable for non-performance caused by force majeure events, including without limitation: prolonged road blockages, natural disasters, general strikes, governmental restrictions, war, embargo, pandemics. The affected party gives notice within a maximum of 48 hours and presents reasonable evidence.

9. Confidentiality

The parties undertake not to disclose sensitive commercial information received from the other party (prices, routes, final customers, volumes). The obligation continues for 3 years after the termination of the contract. For details regarding personal data, see the Privacy Policy.

10. Intellectual property

The content of the absolutefides.com website (texts, images, logo, design) is the property of Absolute Fides SRL and is protected by Law 8/1996 on copyright. Reproduction, distribution or modification without written consent is prohibited.

11. Use of the site

It is prohibited to:

• Use the site for illegal or fraudulent activities
• Upload malicious code, viruses or attack scripts to the site
• Perform automated scraping without prior consent (exception: the AI bots mentioned in robots.txt)
• Impersonate another person or company in the form
• Overload the server with repetitive requests (rate limit active, 3 form requests / hour / IP)

12. Dispute resolution

Any dispute is settled amicably within 30 days from the written notice. If no solution is reached, jurisdiction belongs to the courts at the registered office of Absolute Fides SRL, in accordance with the Romanian Code of Civil Procedure.

For consumers (non-professional natural persons), the special consumer protection provisions apply, including the Alternative Dispute Resolution (SAL) platform: anpc.ro.

13. Governing law

These terms and the relations deriving from them are governed by Romanian law. For international transport, the provisions of the CMR Convention (Geneva 1956) and the applicable EU regulations (Regulation 1071/2009, 1072/2009) prevail.

14. Changes

Absolute Fides may amend these terms periodically. The current version is displayed on this page, with the date of the last update. Substantial changes will be notified to active customers 30 days in advance.
